My friend recommended a divorce lawyer, but she is located in NY, could I use her considering I live in NJ now?… what about Divorce mediators? My ex-to-be and I don’t "hate" each other, and I think we want the same things.. is it easier to use a mediator? any advice is welcome- this is all very new to me. (serious help only)

u can use what ever attorney u want. ur lawyer should be able to negotiate anything on ur behalf. i think there is no need for a mediator unless u want to spend more money. if u and ex can work it out sensibly.

An attorney must be licensed in the state where they will practice. In this case, the attorney must be licensed in New Jersey since the case will be heard by a judge in New Jersey.
If you both use the same attorney, then you get the benefits of a mediator, and don’t end up with competing attorneys who’re likely to egg you two on to behave in ridiculous ways (which just ups the attorneys’ fees).

Yes, a mediator is going to be easier than an attorney, and cheaper.
As to the attorney, where does he live? If he lives in NY, you can probably get a NY attorney. Check with the attorney. If they cannot represent you they have a legal responsibility to let you know as soon as they determine that is the case. Many attorneys in NY are also part of the Bar in NJ, so your atty may still be able to help regardless of where you file.

Does your NY attorney also have a license to practice in NJ? If so you can use your NY attorney. If you are in total agreement on all issues you could file an uncontested divorce.

You need to find an attorney in NJ because it is going to have to be settled by a judge in the county where you two lived together. I didn’t have a mediator, but if you two are on decent talking terms and its a no fault divorce- just talk out what you want. It is a lot easier.
Also, you can check into these uncontested divorce papers you can do yourself- you can buy them online i know. My friend did that with her husband since they agreed on everything. It is a program on your computer that has all the papers, you fill out what you need to, then take it before a judge, both of you, and all you pay is the court costs. It is a lot cheaper than a lawyer.

Just got divorced
The place of marriage does not matter, its where you reside now. You are required to file papers in your state of residency. You can have a lawyer in whatever state you’d want, although common sense would say to have one close by.
If you and your spouse and make this an uncontested divorce it would be the best thing to do. Agree on things, get everything settled then file. Uncontested divorces don’t require lawyers, you can either do them yourself if you feel able to complete the paper work correctly OR you can use a document prep service like below.
If you cannot agree, then yes a lawyer would be necessary. A mediator may be a good alternative if you can’t agree as it would save you guys some time and money.
But again, then best way is to sit down calmly and do your best to make this a divorce that you both agree on. Makes it MUCH easier!
